Terms of Use

These Terms of Use ("Terms") govern your access to and use of gonannyshare.com (the "Site"), operated by Go Nanny Share ("we," "us," or "our"). By using the Site or submitting your information, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

1. What we are, and what we are not

Go Nanny Share operates a marketing and lead-referral service. We connect people who use the Site with third-party companies that may offer products or services. We are not a lender, bank, financial institution, law firm, debt-relief or debt-settlement company, financial or tax advisor, childcare provider, employment agency, or government agency, and we are not affiliated with or endorsed by any government agency or program. We do not provide legal, financial, tax, or professional advice, and nothing on the Site should be treated as such advice.

We do not make credit decisions, provide funding, deliver any regulated service, place or supervise any provider, or set the prices, rates, terms, or outcomes offered by any third party. All products, services, rates, terms, approvals, and outcomes come solely from the third parties you are matched with and are subject to their own review, eligibility criteria, and agreements.

2. No guarantees

We do not guarantee that you will be matched with any particular company, that you will qualify for or receive any product or service, or that you will achieve any particular result, savings, amount, rate, term, timeline, or outcome. Any examples, ranges, or descriptions on the Site are illustrative only and are not promises. Your results depend on your individual circumstances and on the third parties you choose to work with.

3. Eligibility

You must be at least 18 years old and a resident of the United States to use the Site and submit information. By using the Site, you represent that you meet these requirements and that the information you provide is accurate and belongs to you.

4. Consent to be contacted

When you submit a form and check the consent box, you agree that we and the third-party partners we match you with may contact you at the phone number and email address you provide, including by automated dialing systems and prerecorded or artificial-voice calls and text messages, as described at the point of consent and in our Privacy Policy. Consent to be contacted is not a condition of any purchase or service. Message and data rates may apply. You may opt out of texts by replying STOP, and you may ask any caller to stop contacting you. Details are in our Privacy Policy.

5. Your responsibilities

You agree to provide accurate, current, and complete information; to use the Site only for lawful purposes and your own genuine inquiry; and not to submit another person's information without authorization. You agree not to misuse the Site, interfere with its operation, attempt to gain unauthorized access, scrape or harvest data, or use it in violation of any law.

6. Intellectual property

The Site and its content, including text, graphics, logos, and design, are owned by or licensed to Go Nanny Share and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.

7. Third-party services and links

The Site may feature or link to third-party companies, products, and websites. We do not control and are not responsible for those third parties, their offerings, their communications, or their privacy and business practices. Any dealings you have with a third party are solely between you and that third party. We are not a party to, and are not responsible for, any agreement, transaction, or dispute between you and any company you are matched with.

8. Disclaimer of warranties

THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION IS ACCURATE, COMPLETE, OR CURRENT.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Go Nanny Share AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, YOUR INTERACTIONS WITH ANY THIRD PARTY YOU ARE MATCHED WITH, OR THESE TERMS. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITS MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify and hold harmless Go Nanny Share and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

11. Binding arbitration and class action waiver

Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to the Site, these Terms, our Privacy Policy, or any communications you receive as a result of using the Site, will be resolved by binding individual arbitration administered by a recognized arbitration provider under its consumer arbitration rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will take place in Illinois or, at your election, in your home county, and may proceed by phone or video where allowed.

Class action waiver. You and Go Nanny Share agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any class or representative proceeding.

Opt-out of arbitration. You may opt out of this arbitration agreement by sending written notice to privacy@gonannyshare.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. If you opt out, the arbitration and class-action-waiver provisions will not apply to you, and the governing-law and venue provisions in Section 12 will control.

This Section survives termination of these Terms. If any part of this Section is found unenforceable, the remainder will be enforced to the extent permitted by law, except that if the class action waiver is found unenforceable as to a particular claim, that claim will proceed in court.

12. Governing law and venue

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Subject to the arbitration provisions in Section 11, you agree that any claim not subject to arbitration will be brought exclusively in the state or federal courts located in Illinois, and you consent to their jurisdiction and venue.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Effective date" above and post the updated Terms on this page. Your continued use of the Site after changes take effect means you accept the updated Terms.

14. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and Go Nanny Share regarding the Site.
